I. Notice

This Privacy Policy describes how Moniphy, LLC and its divisions — Moniphy Equipment Finance and Moniphy Energy & Commodities (collectively, “Moniphy,” “we,” “us,” or “our”) — collect, use, disclose, and protect information obtained through www.moniphy.com and its subdomains (the “Website”), through our application, inquiry, and lead forms, and through communications with us by phone, email, SMS, or WhatsApp (collectively, the “Services”).

By using the Website or submitting information to us, you consent to the practices described in this Policy and to our Terms & Conditions. If you do not agree, please do not use the Website or submit information to us.

Moniphy operates as a broker and independent transaction facilitator. We do not lend money directly, and we do not take title to, store, or transport physical commodities. Information you submit is used to evaluate, match, and facilitate transactions between you and third-party lending partners, equipment vendors, and verified energy commodity counterparties.

C. Information From Third Parties

With your authorization or as permitted by law, we may receive information from credit bureaus, lending partners, banks, identity-verification and sanctions-screening providers, and business data providers to evaluate financing eligibility or verify commodity counterparties.

III. How We Use Your Information

We use collected information to:

• Evaluate and process equipment financing applications and match you with appropriate lending partners

• Verify counterparties (funds, product, corporate standing) before facilitating energy & commodities introductions

• Coordinate transactions, document flow, and communications between parties

• Communicate with you about your inquiry, application, or transaction

• Send service updates, and where permitted; marketing communications you can opt out of at any time
• Comply with legal, regulatory, anti-fraud, anti-money-laundering (AML), and sanctions-screening obligations

• Improve, secure, and analyze the Website and our Services

• Enforce our agreements, including fee/commission protection agreements (e.g., NCNDA/IMFPA)

IV. How We Share Your Information

We do not sell your personally identifiable information. We share information only as follows:

• Lending partners and funding sources — to evaluate and fund equipment financing requests you submit

• Energy counterparties — buyer or seller information is shared with a counterparty only after applicable verification steps and executed protective agreements, and only as needed to facilitate the transaction

• Service providers — CRM, email, analytics, identity-verification, sanctions-screening, and IT vendors bound by confidentiality obligations

• Legal and regulatory — where required by law, subpoena, court order, or to protect the rights, property, or safety of Moniphy, our clients, or others, including fraud prevention

• Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy

Third parties who receive your information for transaction purposes operate under their own privacy policies and procedures; we encourage you to review them.

V. Email, SMS, and WhatsApp Communications

By providing your contact information, you consent to receive transactional communications regarding your inquiry or deal. Marketing emails include an unsubscribe link, and you may opt out of SMS or WhatsApp messages at any time by replying STOP (SMS) or requesting removal via WhatsApp or email. Opting out of marketing does not affect transaction-related communications.

VI. International Users and Cross-Border Transfers

Our energy & commodities division serves counterparties in the Americas, Europe, the Middle East, and West Africa. Information submitted to us is processed in the United States, whose data-protection laws may differ from those in your jurisdiction. By submitting information, you consent to its transfer to and processing in the United States. We take reasonable measures to protect information involved in cross-border transactions.

VII. Data Security

We use commercially reasonable administrative, technical, and physical safeguards including SSL/TLS encryption for data transmitted through the Website and access controls on deal documentation. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. Financial instruments, banking documents, and verification files should be transmitted only through the secure channels we designate during an active transaction; never through unsecured forms.

VIII. Cookies and Related Technologies

We use cookies, web beacons, and similar technologies to operate the Website, remember preferences, measure advertising effectiveness, prevent duplicate submissions, and analyze usage. Third-party advertising or analytics providers (such as Meta or Google) may set their own cookies or pixels on our pages; their use of information is governed by their own policies, not this one. Most browsers let you refuse or delete cookies; doing so may limit Website functionality.

IX. Data Retention

We retain personal information for as long as needed to fulfill the purposes in this Policy — including evaluating and completing transactions, maintaining required business and compliance records, and resolving disputes — after which it is securely deleted or anonymized. Inactive inquiry data is periodically purged.

X. Your Rights and Choices

Depending on your state or country of residence, you may have rights to access, correct, delete, or receive a copy of your personal information, or to opt out of certain uses. To exercise any of these rights, or to request deactivation of your information, contact us at info@moniphy.com. We will respond within the timeframe required by applicable law. We do not discriminate against you for exercising privacy rights.
